Il contributo analizza la sentenza della Corte costituzionale n. 184 del 2025 con la quale è stata dichiarata l’illegittimità costituzionale di gran parte delle disposizioni della l. r. Sardegna n. 20/2024. La Corte – in conformità alla propria consolidata giurisprudenza sul tema – ha delimitato ulteriormente il ruolo legislativo delle Regioni, alle quali viene riconosciuto quasi esclusivamente un ruolo amministrativo in materia di allocazione degli impianti di produzione di energia da fonti rinnovabili (FER). Vengono quindi compiute alcune riflessioni sulle conseguenze pratiche della sentenza, sul ruolo delle Regioni in materia di FER e sui suoi riflessi sulla tutela del paesaggio e dell’ambiente. Ci si sofferma, infine, sull’importanza di un equo bilanciamento degli interessi – quali la tutela del paesaggio e dell’ambiente, da un lato, e l’interesse allo sviluppo delle FER, dall’altro – e sulla necessità di un ripensamento dell’approccio, sia statale che regionale, rispetto all’adozione delle decisioni relative agli impianti FER

The paper analyzes the Constitutional Court’s ruling no. 184 of 2025, which declared the constitutional illegitimacy of most of the provisions of Sardinia regional law no. 20/2024. The Court – in accordance with its consolidated case law on the subject – has further limited the legislative role of the Regions, which are recognized almost exclusively as having an administrative role in matters of the allocation of renewable energy production plants (RES). Some reflections are then made on the practical consequences of the ruling, on the role of the Regions in renewable energy matters and its implications for landscape and environmental protection. Finally, the paper also focuses on the importance of a fair balance of interests – such as landscape and environmental protection, on the one hand, and the interest in developing renewable energy, on the other – and on the need to rethink the State and Regional approach to the adoption of decisions regarding the RES plants.
